All services provided by BAT Gaming may be used for lawful purposes only. Transmission, storage or presentation of any information,
data or material regarded as unlawful is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or
obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless BAT.Gaming from any claims resulting
from the use of service which damages the subscriber or any other party. NOTICE: IF YOUR ACCOUNT IS FOUND TO CONTAIN ILLEGAL ACTIVITY, ILLEGAL MP3 FILES,
PIRATED SOFTWARE, HACKER PROGRAMS, WAREZ PROGRAMS, OR ANY OTHER ILLEGAL FILES, YOUR ACCOUNT WILL BE TERMINATED IMMEDIATELY, WITHOUT NOTICE, AND A £50.00
CANCELLATION FEE WILL APPLY. ADDITIONALLY, BAT Gaming WILL NOTIFY THE PROPER AUTHORITIES OF YOUR ACTIONS.
Server Abuse
Any attempt to undermine or cause harm to a server or customer of BAT Gaming and BAT Gaming is strictly prohibited.
As our customer you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled
without chance of refund. The services provided are intended solely to provide gaming servers. Anything contained within your account not related to your
game or voice server, including uploaded files, are a violation of the Terms of Service and are subject to account termination without any refunds.
Resale of services
BAT Gaming explicitly forbids the resale of our gaming or voice hosting services without express written consent or a contract permitting the use of.
If you breach this term, your account is subject to immediate cancellation as well as a £50 cancellation fee.
Configuration of Game/Voice Servers
BAT Gaming forbids the client to change the maximum number of slots on your
game/voice server at any time. You are also not permitted to run more servers than you have actaully paid for without prior permission.
BAT Gaming also forbids the modification of
bandwidth "choke", or the amount of packets that are transferred to and from
voice servers each second. Violations of these terms are grounds for a £20 fee.
Refusal of Service
We reserve the right to refuse, cancel or suspend service, at our sole discretion.
Billing
On purchasing a Server Package you are creating a Paypal recurring payment. By the Account Activation Date of each month, BAT Gaming will debit the
client's Paypal account. BAT Gaming shall be entitled to immediately terminate this agreement for client's failure to make timely payments.
You will be provided with an invoice on a monthly basis. It is the client's responsibility to ensure that they have sufficient credit to cover this transaction.
In the event that there is insufficient credit, we will send an e-mail notification, at which point we will need to be provided with another form of payment
within 24 hours. If we do not receive a response within 24 hours, the account, and all accounts under that account plan, will be suspended.
Late Fees
2 payment reminders will be sent out if payment is overdue. The 1st reminder will be sent out the day after the due date, the 2nd reminder will be sent out 3 days after the due date.
If payment isn't received within 7 days of the due date, a £10 late payment fee will be applied to the account. If payment isn't received within 10 days of the due date, account will be suspended
and reactivation fee will be applied. If payment isn't received after the 10 day period, all outstanding charges remain and account will be terminated after 30 days.
Money back guarantee & refund policy
We do not generally refund cancelled contracts. In case of AUP violations, any and all refunds are forfeit.
Account Deactivations
Any account deactivated due to non-payment will require a reactivation fee of £20.00 prior to reactivation.
Cancellation Refunds
We DO NOT refund partial monthly fees to accounts. We require 7 days notice for a cancellation.
Refusal of Service
We reserve the right to refuse, cancel or suspend service, at our sole discretion.
Limitation of Liability
BAT Gaming shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from BAT Gaming servers going
off-line or being unavailable for any reason whatsoever. Furthermore, BAT Gaming shall not be responsible for any claimed damages, including incidental or
consequential damages, resulting from the corruption or deletion of any game or voice server from one of BAT Gaming
servers. All damages shall be limited to
the immediate termination of service.
Violations
Violations of these Acceptable Use Policies should be referred to admin@batgaming.co.uk. All complaints will be
investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.
Disclaimer
BAT Gaming cannot be held liable for system down time, crashes or data loss. Certain services provided by BAT Gaming are resold. Thus, certain equipment,
routing, software and programming used by BAT Gaming are not directly owned or written by BAT Gaming. Moreover, BAT Gaming holds no responsibility
for the use of our clients' accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question.
We reserve the right to remove any account, without advance notice for any reason without restitution, as BAT Gaming sees fit.
Account Activation
By activating your account with BAT Gaming, you agree to the above policies and disclaimer. Upon requesting activation of an account, you are required to
accept these policies, guidelines and disclaimer. NOTICE: If you sign up for an account and fail to comply with these terms, no refunds will be given.
We will, however, advise you by e-mail, MSN or phone prior to taking any action to provide you with an opportunity to correct the problem.
Account Activation Guarantee
BAT Gaming guarantees full server setup within twenty four hours of receiving initial payment.
Server Uptime Guarantee
BAT Gaming guarantees 99.7% service uptime on all gaming/voice hosting plans. Should we fail to deliver this for any given calendar month, your account will
be refunded a pro-rated amount for the duration of excessive downtime. BAT Gaming reserves the right to amend any or all of the above policies,
guidelines and disclaimer without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.
BAT Gaming reserves the right to allocate 12 hours of downtime monthly for scheduled maintenance. We will notify affected parties no less than twenty-four hours
in advance of the scheduled downtime.
Customer Support Policy
BAT Gaming will provide free gaming/voice server configuration support. There will be a service charge of £25 for any maintenance required due to client
mis-configuration. The service charge will only apply if BAT Gaming deems the customer at fault for the mis-configuration of the gaming/voice server.
Server Passwording
BAT Gaming makes no distinction between non-passworded "public" servers, and passworded "private" servers. The customer is permitted to configure their
server as a public server or a private server, and may change password configurations at their discretion.
All servers come with a 100 Mb connection and a fully working control panel, allowing you to be able to easily change the server mod and tracks. We also rent the servers to suit your own need, for example, one off races or monthly championships.
